Please read these Terms (Terms and Conditions) accurately before using and accessing the services offered by Onyx Community Care. These Terms make a legal agreement between Onyx Community Care (Provider, Us, Our, We) and you (Client, Your, You). By using or accessing our services, you acknowledge and recognize that you have read, comprehended, and agree to these bound by all these Terms. Please refrain from using our services if you do not agree to all these Terms and Conditions.

  1. Service Provision

Onyx Community Care offers NDIS services including assistance with personal tasks, community access, support coordination, and personal care among others. We make reasonable efforts to offer services according to your NDIS preferences, goals, and plans, subject to our resources and capacity. However, our services are subject to the presence and availability of qualified people or any limitations imposed by different external factors.

  1. Responsibilities of the Client

As a client, you are accountable for offering complete and accurate information about yourself including your personal goals, support needs, and personal details. You need to promptly inform us of any changes you may make to personal information, circumstances, or NDIS plans that might influence the provision of services. As a client, you agree to participate actively in the review and development of your care plan, offering feedback, and communicating your preferences and needs.

  1. Payment and Fees

For our services, our fees will be outlined and identified in the service agreement or as communicated to you. Upon taking our services, you agree to pay the fees timely as per the schedule of the payment specified in the service agreement. In case you fail to pay for the services, you may be issued a notice prior to the suspension of services.

  1. Changes and Cancellations

You need to offer reasonable or adequate notice for changes or cancellations to scheduled services or appointments. The required period of notice will be communicated and shared with you. In case you fail to offer adequate notice might result in limitations or charges on rescheduling as identified and determined by Onyx Community Care.

  1. Intellectual Property

All IP or intellectual property rights related to our services including content, service marks, logos, and trademarks belong to Onyx Community Care and its licensors. Upon taking our services, you agree not to create works based on IPs, distribute, modify, or reproduce our intellectual property without any form of our prior written consent.

  1. Termination

Onyx Community Care reserves the right to terminate or suspend services immediately in case you engage in any conduct that trespasses or violates these Terms or poses any form of risk to the rights, well-being, and safety of others. You might terminate these services by offering written notice to Onyx Community Care according to the prior-agreed cancellation policy.

All of these Terms shall be managed and governed by the laws of the jurisdiction where Onyx Community Care functions and operations.
